Consumer Law

Consumer relations organized before the complaint

Business defense and compliance with the Brazilian Consumer Defense Code

Consumer complaints keep coming back when the cause lies in the process, the contract or the company's communication. We defend the cases and, above all, correct what generates them.

Situations that call for attention
1

Growing volume of complaints at Procon, on platforms or in small claims courts.

2

Adhesion contracts, terms of use or offers with questionable clauses.

3

Launch of a product, service or digital sales channel.

4

Recall, defective product or failure in service delivery.

Our approach

The best defense starts
with the contract and customer service

In consumer law, Pilli & Fanucchi acts on the side of the supplier company. The goal is to reduce the volume and cost of claims by identifying the practices that generate complaints and adjusting contracts, offers, return policies and customer service routines.

When a claim already exists, we handle the defense in administrative proceedings and lawsuits, individual or collective, with settlement criteria for low-risk cases and full technical defense for those that may set a precedent.

Cause, not just symptom

We analyze complaints together to find the point in the process that originates them.

Frequently asked questions

Questions about Consumer Law

As a rule, yes. The Consumer Defense Code adopts strict liability of the supplier for defects in products and services, regardless of fault. The company may avoid liability by proving, for example, that the defect does not exist or that the consumer or a third party is solely at fault.
For apparent defects, 30 days for non-durable products and services and 90 days for durable ones. For compensation of damage caused by a defect, the limitation period is five years, counted from knowledge of the damage and of who caused it.
It is any communication capable of misleading the consumer about the characteristics, price, quality or other data of a product or service, including by omitting essential information. In addition, a sufficiently precise offer binds the company to fulfill it.
In many cases, yes, especially when the cost of defense exceeds the amount in dispute. Ideally, the company should set objective settlement criteria by type of case, reserving full defense for claims that may create an unfavorable precedent.
The question was submitted to the Superior Court of Justice (STJ) as Repetitive Theme 1,396, analyzed in an article by our team (in Portuguese). In any case, keeping effective customer service channels and recording attempts at resolution strengthens the company's defense.
